Terms of Service

1. Who we are

PerfDeck (the "Service") is provided by [COMPANY NAME], [legal form, e.g. sole proprietorship], [Street, ZIP City, Country], VAT/tax ID [VAT / tax ID], email support@example.com ("we", "us"). These Terms of Service ("Terms") form a binding agreement between you and us. By signing in, buying access or using the Service you accept these Terms. If you do not agree, do not use the Service.

2. What PerfDeck is — and is not

PerfDeck is a web application that computes take-off and landing performance figures for simulated Airbus A320-family aircraft for use exclusively in flight simulation and entertainment. PerfDeck is not a certified aviation product, is not approved by any aviation authority, aircraft manufacturer or airline, and must never be used for the planning or conduct of real-world flight operations. PerfDeck is an independent product. It is not affiliated with, endorsed by or connected to Airbus, NAVBLUE, Fenix Simulations, Navigraph, SimBrief, Microsoft, Discord or any airline. All trademarks belong to their respective owners.

3. Eligibility and account

You must be at least 16 years old (or the age of digital consent in your country). If you are under 18, you confirm that a parent or guardian has agreed to these Terms.
Your PerfDeck account is linked to your Discord account: you sign in with Discord and must keep that account secure. You are responsible for all activity under your account.
One account per person. Accounts are personal and non-transferable.

4. How access is bought

Access is bought on our Discord server. You choose a plan (monthly or yearly) and a payment method; a private ticket opens with our staff, who give you the payment details there. Accepted methods: PayPal, Paysafecard, bank transfer, Revolut or Amazon gift card. Pay only inside your own ticket and only to the details given there. After checking the payment, a staff member activates your access for the period paid (30 days for the monthly plan, 365 days for the yearly plan) and the PerfDeck bot sends you a sign-in link.

There is no free trial: access starts when a staff member activates it after your payment.
Access does not renew automatically. About 7 days before it ends we remind you on Discord; you renew in the same way. New days are added to your current end date.
Prices are those shown on the Pricing page and on our Discord server at the time of payment.

4a. Referral programme

Account holders receive a personal friend code and invitation link. When a new user who entered that code or used that link buys a paid subscription (monthly or yearly), we add one week (7 days) of access to the referrer's account, up to 26 weeks per calendar year. Gifted, test or otherwise unpaid access does not earn a referral week. Referral weeks have no cash value, cannot be transferred or refunded and extend the current access period only. Self-referrals, fake or duplicate accounts and automated sign-ups are not allowed; we may withhold or revoke referral weeks and close accounts in case of abuse. We may change or end the programme at any time; weeks already credited remain valid.

4b. Codes

We may hand out codes for a number of days of access (gifts, giveaways, partners). A code is redeemed once per account, has no cash value, cannot be exchanged or refunded and extends the current access period only. Codes obtained by fraud, resold or published without our consent may be revoked.

5. Prices and payment

Prices are in euro and include VAT where applicable.
Payments are handled by the provider you choose (for example PayPal, Paysafecard, Revolut, your bank or Amazon); their terms apply to the payment. We never ask for your passwords or card details.
We may change prices; changes are announced on our Discord server at least 30 days in advance and never affect periods already paid.
If a payment is reversed or charged back, we may suspend access until the matter is resolved.

6. Right of withdrawal (EU/EEA/UK consumers)

If you are a consumer in the EU/EEA or the UK you normally have the right to withdraw from a distance contract within 14 days. For digital content and services supplied online, this right is lost once the supply has begun with your prior express consent and your acknowledgement that the right is lost. When you pay in your ticket, you expressly ask us to activate your access immediately and acknowledge that you lose your right of withdrawal once your access has been activated. This is also stated in every ticket before you pay. Details are in the Refunds & Cancellation Policy.

7. Licence to use PerfDeck

Subject to these Terms and payment of the fees, we grant you a personal, non-exclusive, non-transferable, revocable licence to use PerfDeck in your web browser during your access period, for flight simulation purposes, on one device at a time. If you sign in on another device, the previous one is signed out.
You may not: share your account or your sign-in links; circumvent the device limit or other access controls; copy, resell, rent, sublicense or distribute PerfDeck; scrape or extract its data or databases with automated tools; reverse engineer it except where expressly permitted by law; use it in a commercial training or real-world aviation context.
PerfDeck, its design, code and databases are protected by copyright and other intellectual property laws and remain our property or that of our licensors.
Access is checked online whenever you use PerfDeck. It ends at the end of the paid period, and may end earlier in case of chargeback or breach of these Terms.

8. Third-party services and content

The eQRH module reproduces the Quick Reference Handbook of the Fenix Simulations A320 (CFM and IAE), used with the permission of Fenix Simulations, for flight simulation only; that content remains the property of Fenix Simulations and its licensors and may not be copied or redistributed. Access, purchases and support take place on Discord; Discord's own terms apply to your use of Discord. PerfDeck can import flight plans from SimBrief (Navigraph) using the SimBrief pilot ID you save in your account; this requires your own SimBrief account and is subject to SimBrief's terms. Data obtained from third-party services remain subject to those providers' terms and may not be redistributed. The airport database is based on public-domain data (OurAirports) and the World Magnetic Model (NOAA); we do not guarantee its accuracy or completeness.

9. Updates, availability and support

We may release updates and change or discontinue features at any time; updates are included in your access. We aim at high availability but do not guarantee uninterrupted operation. Support is provided in private tickets on our Discord server and by email at support@example.com, on a reasonable-effort basis.

10. Acceptable use

You agree not to misuse the Service, including by attempting unauthorised access, interfering with its operation, submitting unlawful content or using automated tools to access it. The rules of our Discord server also apply.

11. Termination

You may delete your account at any time from the account page; this deletes your personal data as described in the Privacy Policy and ends your access without refund of the current period, unless a refund is required by law. We may suspend or terminate your account for breach of these Terms, fraud or chargebacks, with notice where reasonably possible.

12. Warranty and liability

For consumers: statutory warranty rights for digital content apply (in the EU, Directive (EU) 2019/770 as implemented in your country). Nothing in these Terms limits rights that cannot be limited by law.
Otherwise PerfDeck is provided "as is". We do not warrant that the computed figures correspond to the values of any certified performance tool or to the behaviour of any specific simulator add-on.
To the extent permitted by law, we are liable only for damages caused intentionally or by gross negligence, and, in case of slight negligence, only for breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. Our total liability is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for any use of PerfDeck outside flight simulation.

13. Changes to these Terms

We may update these Terms for legal, technical or business reasons. Material changes are announced on our Discord server or in the Service at least 30 days before they take effect. If you do not agree, you may stop using the Service; continued use after that date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of Spain, excluding its conflict-of-law rules. If you are a consumer, you also benefit from the mandatory consumer protection rules of the country where you live, and you may bring proceedings in the courts of that country. For all other cases the courts of Las Palmas de Gran Canaria, Spain have exclusive jurisdiction. Consumers in the EU may also use alternative dispute resolution bodies in their country; we are not obliged and do not commit to participate in such procedures unless required by law.

15. Miscellaneous

If any provision of these Terms is invalid, the remaining provisions remain in force. These Terms, the Privacy Policy, the Refunds & Cancellation Policy and the Disclaimer constitute the entire agreement. The English version prevails over any translation.
